TERM OF USE

• Introduction

  The following terms of use ("Terms of Use") are the terms of a legal agreement between the User (hereinafter referred to as the "User") and GNT Inc. (hereinafter referred to as "GNT Inc."). The GNT Inc. web & wap sites and applications are comprised of various web & wap sites and applications owned and/or controlled by GNT Inc. (collectively referred as the "Services").

  The Services are offered to the User based on the User`s acceptance without modification of the terms, conditions, and notices contained herein and as outlined in the Services. By accessing, browsing and/or using the Services, the User acknowledges that the User has read, understood, and agrees to be bound by these terms and comply with all applicable laws and regulations, including U.S. export and re-export control laws and regulations.

  The User Agreement to all terms, conditions and notices enclosed herein is necessary in order to use these Services. In the event that any of the terms, conditions, and notices contained in these Terms of Use conflict with the additional terms, codes, conduct and/or guidelines contained within any particular Service, then these Terms of Use shall prevail; provided that in the event any use of a game, or application the particular terms of service for that game or application shall prevail.

• Member account, password and security

  If the Services, or any product or other services offered through the Services requires the User to open or create an account, the User must complete the registration process by providing the Services with current, complete and accurate information as prompted by the applicable registration form, either through web or applications. The User then will enter his/her details, including mobile phone number. The User is entirely responsible for any and all activities that occur under the User's account.

  The User agrees to notify GNT Inc. immediately of any unauthorized use of the User account or any other breach of security. GNT Inc. will not be liable for any loss that the User may incur as a result of someone else using the User's mobile phone number, either with or without the User's knowledge.

  The User could be held liable for losses incurred by GNT Inc. or another party due to someone else using the User's mobile phone number.

  The User may not use anyone else's phone number at any time, without the permission of the account holder. The User will be responsible for the maintenance of the mobile phone or the SIM card. User should not distribute or give another User or person the User's personal information. The User will be liable for any loss as a result of inadequate maintenance or misuse and the Services and GNT Inc. will not be liable for any such loss. The User agrees to notify the GNT Inc. immediately if the User believes his/her Mobile Phone may be stolen or used without the User's authorization.

• Rules of Conduct Part 1

  In addition to the limitations set forth in the Terms of Use, the User violates the Terms of Use if the User (or any third parties using the User's Account) does any of the following:

  • The User must be at least 13 years old to join Mobion, if the User lied and in truth younger than 13 years old the User's account will be deleted immediately. If the User lied during the initial sign up and agreed to the terms of service and is not 13 years of age, the User account will be deleted immediately.
  • Give out or exposing the User or other Users personal information.
  • Promote or encourage any illegal activity including hacking, cracking or distribution of counterfeit software or any similar activities.
  • Transmit or facilitate distribution of content that is or maybe harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, stalking, cyber bullying, infringing, invasive of personal privacy or publicity rights, or in a reasonable person's view, objectionable.
• Rules of Conduct Part 2

  • Attempt to acquire other User's account information, or any other private information from a Member or any Users using the Services.
  • Upload or distribute any software or content that the User does not own or does not have permission to freely distribute.
  • Upload files that contain a virus or corrupted data.
  • Improperly use the in-game support or complaint buttons or make false reports to GNT Inc. staff members.
  • Violate the terms of use of any third party tools, interactive service providers, state, local, federal laws, foreign or international law where appropriate.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Charges

    Alerts from Mobion are free for users, although the User's Phone carrier may charge the User for data transfer or use; we recommend an unlimited data plan through your carrier. In the case that Mobion charges Users for the Services, if the User membership has been terminated by GNT Inc. due to a breach of the Terms of Use, GNT Inc. will not be required to refund any purchases or fees in connection with the Services and Mobion services.

  • Mobion Coin System

    Mobion virtual currency, or "Mobion Coin", will be used for online content on Mobion. Mobion reserves the right to provide the registered User with content that the Mobion Coin will be used for at any given time. Mobion Coin can be used in Mobion only and is not transferable to any real money or currency. Mobion Coin will expire immediately when the User is no longer a member of Mobion regardless of the User's membership termination reason.

  • User Posted Content

    • Users are responsible for content, messages, profile, software, games, applications, audio, graphics, designs, text and photographs that the User posts through Mobion. Any User Content posted that is not the User's original work or owned by the User is strictly prohibited as well as any User Content that violates the Copyright laws of any country that can access the Services. Mobion is not obligated to review all User Content to verify all content is original, but if the Services find out that any User Content that is illegal, the Service has the right to immediately delete such content that does not comply with the Terms of Use. GNT Inc. is not liable for any User Content including content that has been deleted.

    • Ownership

      Under the following license between the User and GNT Inc., the User retains ownership of User Content. For any User Content posted by the User, the User agrees to authorize the Services to reproduce, distribute, transmit and use such User Content as necessary to facilitate the posting, storage and transmission of, and the access to, such User Content in connection with the User's use of the Services, including Mobion, and thereby automatically grant GNT Inc. a nonexclusive, worldwide, perpetual, royalty-free, fully paid, transferable license (with the right to sublicense) to the User Content to Use, reproduce, distribute, publicly perform, publicly display, reformat, translate, excerpt, modify, and create derivative works of, such User Content, for any purpose (commercial or noncommercial), including without limitation use in connection with the Mobion Service. The User can remove any content the User has posted on the Services and Mobion at any time.

    • Disclaimer The Service is not responsible for the User Content or the accuracy, reliability or content of the User Content posted on or through the Mobion Service and such User Content does not necessarily reflect the opinions, positions or policies of the Services. The Services and Mobion provide rules and regulations for conduct; the Services and Mobion are not responsible for any offensive, unlawful, obscene or inappropriate content on Mobion.

• Illegal Behavior Part 1

  Illegal behavior involving the use of the Service shall be grounds for the termination of a Member's account. GNT Inc. shall fully co-operate with law enforcement officials on such matters and prosecute such offences to the full extent of the law. Mobion and GNT Inc. will not be held responsible for Users who give out personal information nor be held responsible for Users sending offensive, rude or insulting comments to any individual that could escalate to "stalking" when the messages become threatening or intimidating to the point that the recipient becomes afraid for their safety. Cyber stalking in the United States is prosecuted under stalking laws, making it a Federal offense that carries with it up to eight years in jail and $250,000 in fines. Mobion and GNT Inc. will not be held liable for any Cyber Stalking and Bullying issues or charges made by the end User.

• Illegal Behavior Part 2

  • Upload, post, email, transmit or otherwise make available any Content that the User does not have a right to make available under any law or under contractual or fiduciary relationships -such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.
  • Upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  • Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "pyramid schemes," or any other form(s) of solicitation.
  • Intentionally or unintentionally violate any applicable local, state, national or international law.
• Illegal Behavior Part 3

  The User shall be solely responsible for the User's own submissions and the consequences of posting or publishing them. In connection with the User submissions, the User affirms, represents, and warrants that: the User owns or has the necessary licenses, rights, consents, and permissions to use and authorize the Service to use all intellectual property rights in and to any and all submissions to enable inclusion and use of the same in the manner contemplated by the Service. The User has the written consent, release, and/or permission of each and every individual person in the submission to use the name and/or likeness of each and every such individual person to enable inclusion and use of the same in the manner contemplated by the Service.

• Illegal Behavior Part 4

  The User agrees to pay for all royalties, fees, and any other monies owing any person by reason of any content being posted by the User to or through the Service. By submitting the materials to be uploaded to the Service, the User hereby grants the Service a worldwide, non-exclusive, royalty-free, sublicense able and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the submissions in connection with the Service and its successor's business, including without limitation for promoting and redistributing part or all of the Service and derivative works thereof in any media formats and through any media channels. The User also hereby grants each User of the Service a non-exclusive license to access the Users submissions through the Service, and to use, reproduce, distribute, prepare derivative works of, display and perform such submissions as permitted through the functionality of the Service and under the terms contained herein.

• Indemnification

  The User agrees that the User, will be personally responsible for the Users use of the Site, and that the User agrees to indemnify, defend and hold GNT Inc., and its respective affiliates, employees, officers, and directors and any third parties that are involved directly/indirectly in the Service's management (including but not limited to GNT America Inc.) harmless from and against any and all claims, liability, losses, damages, costs and expenses (including reasonable attorneys' fees) incurred by GNT Inc. in connection with the User's use or alleged use of the Site, including the User's conduct under the rules and regulations of the Services terms. GNT Inc. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, and in such case, the User agrees to cooperate with GNT Inc. in defense of such claims.

• Third Party Services

  The Service may contain links to third party web sites ("Linked Sites"). These Linked Sites are not under the control of GNT Inc. and GNT Inc. is not responsible for the contents of any Linked Sites, including without limitation, any links contained in a Linked Site, or any changes or updates to a Linked Site. GNT Inc. is not responsible for webcasting or any other form of transmission received from any Linked Site, nor is GNT Inc. responsible if the Linked Site is not working appropriately. GNT Inc. is providing these links to the User only as a convenience, and the inclusion of any link does not imply endorsement by GNT Inc. of the Linked Site or any association with its operators. Users are responsible for viewing and abiding by the privacy statements and Terms of Use posted on the Linked Sites.

  Any dealings with third parties (including advertisers) included within the Service or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between the User and the advertiser or other third parties. GNT Inc. shall not be responsible or liable for any part of any such dealings or promotions.

  Users will receive messages; email or SMS messages, from GNT Inc. and 3rd parties. Users may receive offers to use 3rd party content for Free as a user of the Services. It is the sole responsibility of the User who chooses to click any advertisement or use any 3rd party services in means of loss, damage, fees, regardless of the target, etc. The Company will review the content of advertisements at random.

• Liability Disclaimer Part 1

  THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SERVICES MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY MADE TO THE SERVICES AND TO THE INFORMATION THEREIN. GNT Inc., AND ITS RESPECTIVE AFFILIATES, EMPLOYEES, OFFICERS, AND DIRECTORS AND ANY THIRD PARTIES THAT ARE INVOLVED DIRECTLY/INDIRECTLY IN THE SERVICE'S MANAGEMENT (INCLUDING BUT NOT LIMITED TO GNT AMERICA INC.) MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SERVICES AT ANY TIME WITH OR WITHOUT PRIOR NOTIFICATION.

  GNT Inc., AND ITS RESPECTIVE AFFILIATES, EMPLOYEES, OFFICERS, AND DIRECTORS AND ANY THIRD PARTIES THAT ARE INVOLVED DIRECTLY/INDIRECTLY IN THE SERVICE'S MANAGEMENT (INCLUDING BUT NOT LIMITED TO GNT AMERICA INC.) WILL NOT BE HELD LIABLE FOR USERS RESPONSIBLE OF CYBERBULLYING, STALKING, TRANSMITTING PERSONAL INFORMATION ON Mobion. USERS WHO BREACH THESE RULES WILL BE HELD ACCOUNTABLE FOR THEIR OWN ACTIONS AND NOT GNT Inc., AND ITS RESPECTIVE AFFILIATES, EMPLOYEES, OFFICERS, AND DIRECTORS AND ANY THIRD PARTIES THAT ARE INVOLVED DIRECTLY/INDIRECTLY IN THE SERVICE'S MANAGEMENT (INCLUDING BUT NOT LIMITED TO GNT AMERICA INC.)

  GNT Inc., AND ITS RESPECTIVE AFFILIATES, EMPLOYEES, OFFICERS, AND DIRECTORS AND ANY THIRD PARTIES THAT ARE INVOLVED DIRECTLY/INDIRECTLY IN THE SERVICE'S MANAGEMENT (INCLUDING BUT NOT LIMITED TO GNT AMERICA INC.) MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, CONTENT AND RELATED GRAPHICS CONTAINED WITHIN THE SERVICES FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, CONTENT AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. GNT Inc. AND/OR ITS RESPECTIVE SUPPLIER, GNT AMERICA, INC HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, COMMUNICATIONS, CONTENT AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, TITLE AND NON-INFRINGEMENT.

• Liability Disclaimer Part 2

  IN NO EVENT SHALL GNT Inc., AND ITS RESPECTIVE AFFILIATES, EMPLOYEES, OFFICERS, AND DIRECTORS AND ANY THIRD PARTIES THAT ARE INVOLVED DIRECTLY/INDIRECTLY IN THE SERVICE'S MANAGEMENT (INCLUDING BUT NOT LIMITED TO GNT AMERICA INC.) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICES, WITH THE DELAY OR INABILITY TO USE THE SERVICES OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, CONTENT AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICES, OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF GNT Inc. OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO THE USER. IF THE USER IS DISSATISFIED WITH ANY PORTION OF THE SERVICES, OR WITH ANY OF THESE TERMS OF USE, THE USER'S SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES.

• Intellectual Property

  The Service, including, without limitation, all communication features, contain copyrighted material, trademarks and other proprietary information including, without limitation, text, software, photographs, videos, graphics, music and sound, and the entire contents of the Service and each area contained therein are the property of GNT Inc. and/or our third-party content providers. GNT Inc. owns a copyright in the selection, coordination, arrangement and enhancement of such content. The User shall not modify, publish, transmit, participate in the transfer or selling of, create derivative works, or in any way exploit, any of the content contained on the Service (including, without limitation, content that GNT Inc. that is downloadable) without the written permission of GNT Inc. and the respective copyright owners. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark, or copyright notice shall be made. The downloading of copyrighted material from the Service is allowed by the User only for the User's own use. The User acknowledges that GNT Inc. and/or third-party content providers remain the owners of all materials posted on the Service, and that the User does not acquire any of those ownership rights by downloading copyrighted materials.

• Copyright Notice Part 1

  All content, applications and software ("Software") (if any) that is made available to view and/or download in connection with the Service is owned by and is the copyrighted work of GNT Inc. and/or its suppliers and is protected by copyright laws and international treaty provisions. The User's use of the Software is governed by the End User License, if any, which accompanies or is included with the Software ("License Agreement"). The User may not install or use any Software that is accompanied by or includes a License Agreement unless the User first agrees to the License Agreement terms.

  For any Software not accompanied by a License Agreement, GNT Inc. hereby grants to the User, a revocable personal, non-transferable license to use the Software for viewing and otherwise using the Service in accordance with these Terms of Use, and for no other purpose provided that the User keeps intact all copyright and other proprietary notices. Any reproduction or redistribution of the content and software is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE CONTENT OR SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED.

• Copyright Notice Part 2

  For all User submissions (including User Content), the User agree that the User will not: submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the User is the owner of such rights or has permission from the rightful owner, in accordance with the aforementioned, to post the material and to grant the Services and Mobion all of the license rights granted herein.

  Posting of the following is strictly prohibited:

  • Publish falsehoods or misrepresentations that could damage the Services and Mobion or any third party.
  • Post advertisements or solicitations of business.
  • Submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, is inappropriate, or violates any laws.
  • Impersonation of another person. Mobion does not endorse any User submission or any opinion, recommendation, or advice expressed therein, and Mobion expressly disclaims any and all liability in connection with any submissions. Mobion does not permit copyright infringing activities and infringement of intellectual property rights on Mobion, and the Services and Mobion reserves the right to remove any submission at its discretion without prior notice.
• Copyright Notice Part 3

  The User agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. Mobion trademarks and service marks and other Mobion logos and product and service names are trademarks of Mobion. (the "Trademarks"). Without Mobion's prior permission, the User agrees not to display or use in any manner, the Trademarks.

  CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT Mobion respects the intellectual property of others and has the right under Mobion's discretion, to disable and/or terminate the accounts of Users who Mobion believes are infringers. If the User believes that the User's work has been copied in a way that constitutes copyright infringement, or the User's intellectual property rights have been otherwise violated, please provide Mobion the following information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright / intellectual property interest.
  • A description of the copyrighted work or other intellectual property that the User claims has been infringed. A description of where the material that the User claims is infringing is located on the Service.
  • A statement by the User that the User has a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law and a statement by the User, made under penalty of perjury, that the above information in the User Notice is accurate and that the User is the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. Please include the User's address, telephone number, and email address.
• Trademark Notice

  GNT Inc. and Mobion (inclusive of logos and designs.), are trademarks or registered trademarks of GNT Inc. in the US, Japan and other countries. All other names of companies and products mentioned herein may be trademarks of their respective owners and are used with permission. Any such trademarks may be used publicly only with permission from GNT Inc. or their respective owners. All rights not expressly granted herein are reserved.

• Rules and Behavior Policy

  GNT Inc. and Mobion (inclusive of logos and designs.), are trademarks or registered trademarks of GNT Inc. in the US, Japan and other countries. All other names of companies and products mentioned herein may be trademarks of their respective owners and are used with permission. Any such trademarks may be used publicly only with permission from GNT Inc. or their respective owners. All rights not expressly granted herein are reserved.

• Guidance When Having Problems with Other Users

  It is recommended to "Block" said user by going to their page and clicking the Block link.

  All Users will take full responsibility for his or her actions and Mobion and GNT Inc. will not be held accountable for any such actions detailed above or stated under the Terms and Service agreement upon Sign up.

  If another User has done something which the User feels has harmed the User or is inappropriate on the Service please Report said user by clicking the Report link on said user's page.
